Trutanich Seeks to Stop New Encino Pot Shop

The city attorney continues his fight against medical marijuana dispensaries.

Los Angeles City Attorney Carmen Trutanich is seeking a court injunction to prevent a medical marijuana dispensary from opening in an Encino strip mall, his office said Friday, according to City News Service.

Frank Mateljan, a spokesman for the city attorney's office, told Patch that the proposed location for the pot shop is in a shopping center at 15826 Ventura Blvd. The center, said Mateljan, is close to and . Both of these locations, he said, have schools on the premises.

"It's against the zoning code," said Mateljan. "It's illegal in a shopping center."

The center is currently home to stores that include and spa.

Those hoping to lease the store space for the marijuana dispensary had previously owned another pot shop in Encino called the Coffee Joint that "had been cited and shut down," according to Mateljan.

"The LAPD conducted an undercover operation, and narcotics were sold to those officers," Mateljan said.

That's because that area is in North Hollywood, a mostly hispanic neighborhood. None of the politicians cares, because those people can't vote, since there illegal immigrants.

Mark S. the City has actually 'shut down' only a few pot shops. In most cases the landlords kicked out their tenants after receiving warning letters from Trutanich. The tenants then moved to another location and opened up again. The LA Weekly found that most, if not all, of the 538 pot shops in LA are still in existence, just in different locations. The City is unable to effectively shut them down because instead of working with the few legitimate medical marijuana dispensaries to come up with a workable law like he promised he would to get their support, Trutanich went nuts and decided to close all of them down. Unfortunately, Trutanich didn't know the law very well and the original ordinance he wrote was flawed and a Superior Court judge has declared most of Trutanich's law unconstitutional. That's why he has to try to pass a new law with a lottery in it. It's all a little to complicated for Trutanich, so he's not doing much about the existing 538 shops, just trying to grab headlines where he can by preventing new shops from opening. Trutanich is bailing out of the City Attorney's office anyway, he is going to run for District Attorney and leave the pot shop mess to someone else.

Thank for this info Jack! You would think the City would target shops that are truly a nuisance and/or with sensitive uses all around them. Also taking forever for the Lottery to take place. I wonder what the hold up is? It will also be interesting to see what happens with the dispensaries when SB1300 goes into effect Jan.1st. 2012. I believe that is the new Bill the Gov. Jerry Brown just signed into law that leave individual Counties and Cities to regulate shops or close them down all together without the threat of being sued. Local law enforcement will also be involved in the shut downs.

Encino now has @ least 5 MMJ shops....the CIty COunsel bungled the whole situation, they should have allowed all the pre-ban REGISTERED shops (pre 2009 or so) & go after the new rogue ones, but our greedy consel (on everything it appears) wanted a total ban, which will be illegal under CA law, the CA Supremes already said so.....Bottom line less shops are desired, but the whole thing is BS, legalize it & tax it...endof story release non-dealer pot related incarceration - the USA spends +/- $400,000,000 jailing people for pot POSSESSION. tAX WOULD MAKE ABOUT $100,000,000 a year or more (whole USA) a National swing of half a billion dollars...the FEd$ say no, Phizer says no (but got a DEA permit to grow pot to extract THC & other for a pill use!>?) silly prohibition worked so well for booze, now the UN claims Wash & Colo. violate UN law, get friggin real. We have real concenrs & pot has been used for 1,000's of years & is a plant, how do you otlaw mother nature....don't know but the US Supreme Court ignores the Constitution on this issue, where are the FEDS given power to outlaw drugs???? nowhere....
